The University of Baghdad/ college of law discussed the doctoral dissertation in the criminal law branch of the student (Hussein Allawi Hashim), marked with (the uniqueness of the legislative model of the criminally protected interest), on Thursday, 2023/11/02 at the conference hall at the college.
The dissertation aims to develop a framework or a general theory of the idea of individualizing the legislative model of the protected interest, the rooting of principles, the development of a general theory that connects the various crimes and facilitates their study and understanding of their composition, the statement of the basic elements that make up the crime, identify the elements of the crime and distinguish between the pillars, elements and circumstances .
The dissertation included three chapters, the first one dealt with the conceptual framework for the uniqueness of the legislative model of the criminally protected interest, the second chapter dealt with the elements of the uniqueness of the legislative model of the criminally protected interest and its cases, while the third chapter dealt with the effects of the uniqueness of the legislative model of the criminally protected interest.
The dissertation came up with several recommendations, the most important parts are proposes to the Iraqi legislator to apply the theory of individualizing the legislative model of the criminally protected interest and its subsequent ideas, and suggests to the Iraqi legislator to adopt the criterion of protected interest in the division of crimes from the special section of the Penal Code.
