The College of Law at the University of Baghdad discussed on Sunday, 01/10/2023, in the conference hall of the college, a master’s thesis in criminal law by the student (Farah Ansif Jassim) entitled (The forensic medical report and the authority of the criminal court in its assessment – a comparative study).
The thesis aims to highlight the importance of forensic medicine in the world of crime, as it helps to uncover the truth after the investigation has failed to establish the circumstances and identify the perpetrators. In practice, forensic medicine is one of the means by which the investigator, examining magistrate or court can establish the facts and gather evidence.
The thesis consisted of three chapters, the first of which dealt with the concept of the forensic medical report, the second with the role of the forensic medical report in the criminal case, and the third with the authority of the criminal court in evaluating the forensic medical report.
The main recommendations of the study The request of the Iraqi legislator to amend the text of Article 39 of the Code of Criminal Procedure by adding the phrase (summoning the forensic doctor or a forensic specialist) in order to inspect the material effects and remove them accurately. The request of the Iraqi legislator to amend the text of article 39 of the Iraqi Code of Criminal Procedure of 1971 by replacing the term (the place of the accident) with (the scene of the crime).
