The College of Law at the University of Baghdad discussed PHD thesis in the private law branch of the student Asma Abdel-Sattar Ahmed, entitled (The Role of the Trustee in Restructuring Banks), on Wednesday, 8/16/2023, in the college’s model courtroom.
The discussion committee consisted of, Professor Dr. Ali Fawzi Ibrahim as Chairman, Professor Dr. Jalil Hassan Al-Saadi as member, Assistant Professor Dr. Israa Khudair Khalil as member, Assistant Professor Dr. Haifa Mazhar Falhi as member, Assistant Professor Dr. Andalus Hamid Abd as member, Assistant Professor Dr. Khalis Nafi Amin. member and supervisor.
The thesis aims to study and explain the reasons for restructuring, which are financial distress and weak banking management, and attempt to provide successful solutions that help in restructuring by explaining the role of the trustee in administrative and financial restructuring and other solutions that the trustee proposes in restructuring.
The thesis also included three chapters, the first of which dealt with restructuring banks, the second chapter the relationship of the trustee to restructuring banks, and the third chapter dealt with the trustee’s options in restructuring banks.
The most important recommendations reached by the study: The Iraqi legislator, when organizing the restructuring of banks, should give this task to a specialized body of experts, accountants, and jurists without relying entirely on the efforts of the trustee to accomplish that work, as limiting the task of reorganization to the central bank in consultation with the trustee only was not an approach. Correctly, because the participation of other people besides the trustee allows for more mature ideas. Work on conducting intensive training courses for employees in the field of banking in order to keep pace with the developments taking place. He also hopes for the need to spread awareness in the commercial community and inform them of the importance of the legal provisions related to bankruptcy.
